Welcome to Text Torrent. By accessing or utilizing the services provided by Text Torrent, Inc. ("Company," "we," "us," or "our"), you acknowledge that you have read, understood, and agreed to be legally bound by these Terms and Conditions (the "Agreement"). If you do not agree with any part of this Agreement, you must cease use of our services immediately.

2. User Obligations and Compliance

Users of the Text Torrent platform shall adhere to all applicable local, state, and federal laws and regulations, including but not limited to, compliance with the messaging and telecommunications guidelines set forth by Twilio, Inc. Users acknowledge and agree that:

• The use of our platform is contingent upon strict adherence to Twilio's Acceptable Use Policy and any applicable carrier regulations.
• Any transmission of messages deemed unlawful, fraudulent, misleading, or in violation of any applicable policies shall result in immediate suspension or termination of the user’s account, without refund or recourse.
• Users bear sole responsibility for the content, legality, and recipient compliance of all messages sent through the Text Torrent platform.
• Engaging in chargeback disputes following valid service usage constitutes fraudulent activity and shall result in account termination and legal action.

3. Service Suspension, Termination, and Account Liability

Text Torrent reserves the right to suspend, restrict, or permanently terminate a user’s access to our services under any of the following circumstances:

• Violation of Twilio's messaging policies or any carrier compliance requirements;
• Engagement in fraudulent, deceptive, or abusive conduct;
• Initiation of chargeback disputes on validly rendered services;
• Failure to comply with these Terms and Conditions.

Upon termination, users forfeit all associated data, credits, and any remaining balance. No refunds or prorated reimbursements shall be issued under any circumstances.

4. Billing, Payment Terms, and Dispute Resolution

• All transactions processed through Text Torrent are final and non-refundable, except where a demonstrable system error has prevented service utilization.
• Users acknowledge that initiating a chargeback dispute without first seeking resolution through Text Torrent’s internal dispute process shall be considered a material breach of this Agreement.
• Any fraudulent chargeback attempts will result in the immediate revocation of service, permanent account termination, and may be pursued for collection and damages.

5. Refund Policy

• Refunds shall not be issued for any used messaging credits under any circumstances.
• Refund eligibility is limited to cases where a verifiable platform failure has prevented successful transmission of messages.
• Refunds will not be provided for accounts suspended or terminated due to violations of Twilio’s guidelines or non-compliance with these Terms.
• Users attempting chargebacks or engaging in refund fraud will be permanently blacklisted from the platform.

6. Twilio & Third-Party Account Restrictions

• Twilio sub-accounts created through Text Torrent remain the exclusive property of Text Torrent and may not be transferred to users upon termination of service.
• Users who cancel or are removed from the Text Torrent platform shall have their associated Twilio accounts deactivated and permanently closed.
• Any attempt to retain or transfer Twilio accounts linked to Text Torrent after service termination shall constitute a violation of these Terms and may result in legal action.

7. Privacy Policy & Data Security

• Users' personal and billing information shall be handled in accordance with our Privacy Policy and all applicable data protection laws.
• Text Torrent implements industry-standard encryption and security protocols to safeguard user information; however, users acknowledge that no system is completely invulnerable to breaches.
• Users explicitly waive any right to dispute valid billing transactions post-service usage.

8. Contact and Dispute Resolution Process

All disputes, inquiries, or concerns regarding these Terms and Conditions shall be directed to Info@texttorrent.com prior to initiating any formal dispute proceedings.

By continuing to use Text Torrent, users affirm their understanding and acceptance of these Terms and Conditions in their entirety.
