Acceptable Use Policy

1. Introduction

This Acceptable Use Policy ("Policy") is incorporated by reference into the Terms of Service of Text Torrent, INC ("Text Torrent," "we," "us," or "our") and applies to all users of our platform and Services. This Policy is designed to ensure the lawful, responsible, secure, and compliant use of the Services provided through https://texttorrent.com (the "Site") and any associated systems, tools, integrations, or communications functionality made available by Text Torrent, including, without limitation, SMS messaging, MMS messaging, calling, voicemail, call routing, call forwarding, call recording, conference calling, caller ID and local presence features, AI-powered communications tools, and other Twilio-powered or third-party communications features (collectively, the "Services").

By accessing or using the Services, you agree to comply with this Policy, our Terms of Service, and all applicable laws, regulations, carrier requirements, and industry rules. If you violate this Policy, we may suspend, restrict, or terminate your access to the Services without notice and may pursue any other remedies available to us at law or in equity.

For purposes of this Policy, "Voice Services" means any calling, voice, call-routing, forwarding, voicemail, conference, caller ID, local presence, recording, monitoring, transcription, queueing, IVR, or related telephony or communications functionality made available through the Services.

2. Prohibited Conduct

You agree not to use the Services, or permit any other person to use the Services through your account, in any way that:

(a) Violates Laws, Regulations, or Carrier Rules

  • Violates any applicable local, state, federal, or international law, rule, regulation, order, or legal obligation.
  • Violates any telecommunications, privacy, telemarketing, consumer protection, anti-spam, anti-spoofing, or call-recording law, including without limitation the TCPA, TSR, CAN-SPAM Act, FCC rules, CTIA guidelines, A2P 10DLC requirements, Do Not Call rules, caller ID laws, wiretap laws, privacy laws, or any carrier, telecom provider, or upstream provider policy.
  • Supports, facilitates, promotes, or conceals illegal activity, fraud, deception, phishing, impersonation, evasion, harassment, abuse, or scams.

(b) Violates Messaging Rules or Messaging Compliance Requirements

  • Sends unsolicited SMS, MMS, or other messages, including spam, unlawful mass messaging, or any communication sent without legally sufficient consent where consent is required.
  • Uses misleading sender information, false phone numbers, deceptive message headers, or misleading message content.
  • Fails to obtain and maintain valid express consent, prior express consent, prior express written consent, or any other form of consent required by law for messaging activity.
  • Fails to maintain verifiable proof of consent, including the date, time, method, IP address, source, and content of the opt-in, and to provide such proof to Text Torrent promptly upon request.
  • Fails to include legally required opt-out instructions, including "Reply STOP to unsubscribe" or equivalent language where required.
  • Messages any phone number that has opted out, revoked consent, appears on a suppression list, appears on the Blacklist Page, or has been flagged through keyword automation or any other opt-out or compliance workflow.
  • Attempts to bypass, disable, manipulate, evade, or interfere with any compliance or enforcement tool made available through the platform, including blacklists, suppression tools, keyword filters, throttling limits, approval workflows, account restrictions, or monitoring systems.

(c) Violates Calling, Voice, or Telemarketing Rules

  • Places, initiates, routes, forwards, transfers, facilitates, or causes any call in violation of any applicable telemarketing, robocalling, privacy, consumer protection, caller ID, or telecommunications law or regulation.
  • Places calls to any number in violation of any federal, state, internal, carrier, or other Do Not Call list, registry, request, or suppression requirement.
  • Places marketing, solicitation, or telemarketing calls without the level of consent required by applicable law.
  • Uses prerecorded voice, artificial voice, voicemail drops, ringless voicemail, or similar call content without all legally required consent, notice, and authorization.
  • Places calls that are deceptive, misleading, abusive, harassing, threatening, fraudulent, or intended to impersonate another person or entity.
  • Uses autodialing, bulk calling, automated calling, or any calling workflow in a manner that violates applicable law, provider rules, or this Policy.

(d) Engages in Unlawful Recording, Monitoring, or Interception

  • Records, monitors, listens to, joins, whispers into, barges into, transcribes, intercepts, stores, or otherwise processes any call, voicemail, or communications content without providing any notice or obtaining any consent required by applicable law.
  • Enables or uses call recording, call monitoring, whisper, barge, conference, transcription, voicemail recording, or similar features in any jurisdiction or context where such use is unlawful.
  • Uses recordings, transcripts, voicemail audio, or communications data for any unlawful, deceptive, invasive, or unauthorized purpose.

(e) Uses Caller ID, Local Presence, or Number Presentation Improperly

  • Uses false, misleading, deceptive, inaccurate, or unauthorized caller ID information, local presence numbers, display names, business identity information, or number presentation practices.
  • Impersonates, misrepresents, or falsely suggests affiliation with any person, business, government entity, carrier, regulator, or organization.
  • Uses any number, caller ID, local presence number, or business identity that you are not authorized to use.
  • Uses caller ID rotation, local presence, or similar features to evade detection, mislead recipients, avoid complaint tracking, or disguise the origin, identity, location, or purpose of a call or message.

(f) Abuses the Platform, Infrastructure, or Communications Providers

  • Sends or attempts to send excessive traffic that overloads, disrupts, degrades, or interferes with our systems, third-party gateways, Twilio infrastructure, carrier infrastructure, or any other provider systems.
  • Manipulates or falsifies delivery confirmations, read statuses, call statuses, call results, responses, opt-outs, recordings, routing outcomes, or any other platform or communications data.
  • Uses the Services in a way that disrupts the platform, other users, our integrations, or the experience of recipients or counterparties.
  • Attempts to evade spam labeling, carrier filtering, traceback requests, fraud controls, caller authentication systems, provider monitoring, or any compliance or abuse-prevention mechanism.

(g) Infringes on Others' Rights or Harms Others

  • Sends, uploads, stores, transmits, or facilitates content that infringes or violates any third party's intellectual property, privacy, publicity, contractual, or other legal rights.
  • Uses the Services to harass, threaten, stalk, intimidate, extort, defame, abuse, or harm any person or group.
  • Engages in unauthorized impersonation, identity misrepresentation, or deception in connection with any message, call, campaign, or account activity.

(h) Contains, Promotes, or Distributes Harmful Content

  • Distributes content that is defamatory, obscene, sexually explicit, abusive, hateful, discriminatory, deceptive, exploitative, or otherwise unlawful or harmful.
  • Uploads, transmits, or distributes viruses, malware, spyware, malicious code, credential-harvesting tools, or any software or content designed to damage, disrupt, surveil, or gain unauthorized access to devices, systems, or data.
  • Uses the Services to facilitate phishing, credential theft, malware delivery, fraud, or other harmful activity.

(i) Misuses AI, Automation, or Compliance Assistance Features

  • Uses AI-generated content, compliance suggestions, message rewrites, calling scripts, or other platform assistance tools in a way that violates law, carrier rules, this Policy, or the rights of others.
  • Represents or relies on any compliance guidance, content suggestion, or automated output generated by Text Torrent as legal advice or as a guarantee of compliance.
  • Uses AI, automation, scripting, or platform tools to generate unlawful communications, deceptive campaigns, fraudulent impersonation, or abusive outreach.

Message and Calling Assistance Disclaimer: From time to time, Text Torrent may provide guidance, suggestions, automated rewrites, AI-generated content, call-related tools, or compliance-oriented recommendations intended to improve deliverability, workflow efficiency, or alignment with best practices. These are provided strictly as informational or operational tools and do not constitute legal advice, compliance approval, or a guarantee that any communication, campaign, call flow, recording practice, or use of the Services complies with applicable law, carrier requirements, or provider rules. You remain solely responsible for the content, recipients, routing, consent, recording practices, caller ID usage, and legality of all messages and calls sent or processed through your account.

3. Restricted Industries and Use Cases

The following industries, campaigns, use cases, message types, or calling activities are prohibited on the Services unless expressly pre-approved by Text Torrent in writing, and even if pre-approved, may only be used in strict compliance with all applicable laws, carrier rules, and platform requirements:

  • debt relief, debt settlement, debt consolidation, debt elimination, debt negotiation, or credit repair services;
  • loan forgiveness, credit restoration, credit score improvement, or similar financial relief services;
  • high-interest loans, payday loans, short-term loans, merchant cash advances, or similar financing offers, unless specifically pre-approved by Text Torrent and operated in a compliant manner;
  • gambling, sports betting, casinos, sweepstakes, lotteries, raffles, prize promotions, or chance-based promotions where prohibited or restricted;
  • illegal drugs, controlled substances, CBD, cannabis-related products, drug paraphernalia, or unapproved supplements;
  • sexually explicit, pornographic, escort, adult entertainment, or other adult-oriented content or services;
  • weapons, firearms, ammunition, explosives, or related accessories;
  • phishing, impersonation, fake giveaways, fraudulent lead generation, deceptive affiliate marketing, multi-level marketing schemes, or misleading business opportunities;
  • unlawful robocalling, unlawful telemarketing, ringless voicemail abuse, prerecorded voice campaigns without proper consent, or any other calling activity that presents elevated legal, carrier, or reputational risk;
  • any use case that Text Torrent, in its sole discretion, determines to be high-risk, deceptive, abusive, unlawful, non-compliant, or likely to result in complaints, carrier enforcement, regulatory scrutiny, reputational harm, or disruption to the Services.

Use cases that fall into the foregoing categories may be rejected, suspended, restricted, or terminated immediately, with or without notice and with or without refund.

Third-Party Gateway and Voice Provider Use: If you connect a third-party messaging gateway, voice provider, SIP provider, or other communications provider (including Twilio, Telnyx, Plivo, or similar services) to the Services, you are solely responsible for ensuring compliance with all applicable laws, provider terms, carrier rules, and this Policy. Text Torrent is not liable for delivery failures, blocked messages, blocked calls, spam labeling, call filtering, provider suspensions, carrier enforcement, traceback activity, or penalties arising out of your use of third-party services.

4. Account Security and Access

You are responsible for maintaining the confidentiality and security of your login credentials, API credentials, subaccounts, numbers, calling configurations, messaging configurations, and any access to the Services provided under your account. You agree not to:

  • share your password, API token, authentication credentials, or account access with unauthorized persons;
  • create or provide subaccounts, workspaces, or access credentials to third parties that are not legitimately authorized by your business or account owner;
  • use another user's credentials, number resources, caller IDs, subaccounts, or account access without permission;
  • provide false, misleading, incomplete, or impersonated information in connection with account creation, business verification, compliance review, phone number registration, or use of the Services;
  • conceal the identity of the actual user, sender, caller, business, or campaign owner operating through an account.

If we detect suspicious access, fraud indicators, security concerns, compliance concerns, or activity suggesting unauthorized or high-risk use of the Services, we reserve the right to disable, restrict, suspend, or require verification of your account, numbers, calling features, or messaging features before restoring access.

5. System Monitoring and Enforcement

We may monitor, review, analyze, log, or investigate account activity, messaging traffic, calling activity, routing behavior, recordings, compliance data, and general use patterns to protect the Services, enforce this Policy, investigate abuse, and satisfy legal, carrier, or provider obligations. Such monitoring may include, without limitation:

  • review of message logs, phone numbers, sender information, and campaign activity;
  • review of call logs, routing data, caller ID usage, local presence usage, forwarding configurations, voicemail activity, queue and IVR activity, conference activity, and related calling records;
  • analysis of opt-out rates, complaint patterns, call complaint patterns, spam labeling, carrier filtering, traceback activity, and other abuse or compliance indicators;
  • investigation of suspected fraud, impersonation, phishing, spoofing, telemarketing abuse, robocalling abuse, unlawful recording, or other misuse of the Services;
  • review of consent records, suppression workflows, registration data, and compliance documentation provided by you.

We reserve the right, in our sole discretion, to:

  • suspend, disable, restrict, or terminate accounts, subaccounts, numbers, messaging access, calling access, recordings, integrations, or specific features that violate this Policy or present legal, carrier, provider, fraud, abuse, security, or reputational risk;
  • block messages, calls, numbers, caller IDs, local presence features, destinations, campaigns, or account activity that we believe may violate law, carrier rules, provider rules, our Terms, or this Policy;
  • request scripts, consent records, call samples, message samples, campaign details, business verification documents, call-routing details, recording practices, or other information reasonably necessary to review compliance;
  • report unlawful, abusive, fraudulent, or suspicious conduct to carriers, gateway providers, upstream providers, traceback consortiums, law enforcement, regulators, courts, or other relevant parties; and
  • share relevant account data, call data, message data, routing records, recordings, consent records, and related information with Twilio or other integration partners, providers, or authorities in connection with incident review, abuse investigation, compliance review, traceback response, fraud prevention, or legal process.

We may suspend or terminate accounts immediately and without prior notice if we determine that your activity presents a legal, regulatory, carrier, fraud, abuse, operational, or reputational risk.

6. Consequences of Violations

Violations of this Acceptable Use Policy may result in any action Text Torrent deems appropriate in its sole discretion, including without limitation:

  • immediate suspension, restriction, or termination of your account or subaccounts;
  • suspension, disabling, or permanent revocation of phone numbers, caller IDs, local presence features, messaging access, calling access, recordings, integrations, or related Services;
  • permanent blacklisting of phone numbers, sender identities, caller IDs, IP addresses, domains, businesses, or associated users;
  • loss of credits, prepaid balances, subscription access, or access to specific platform features, without refund where permitted by law;
  • rejection, cancellation, or removal of campaigns, call flows, numbers, recordings, or other account assets;
  • referral to carriers, providers, traceback organizations, law enforcement, regulators, or other authorities; and
  • legal action to recover damages, protect the Services, enforce our agreements, or seek injunctive or other relief.

Message Formatting and Communications Billing Disclaimer: Use of spintext, merge fields, personalization tools, AI-generated content, dynamic content, special characters, emojis, accented letters, non-GSM characters, call forwarding, voicemail, recordings, transcription, or other communications features may affect the final length, routing, billing treatment, or usage measurement of a message or call. As a result, the number of credits, billable segments, minutes, storage usage, or related charges may differ from any preview, estimate, or template view. By using these features, you accept responsibility for any resulting variations in billing or usage.

6.1. No Reliance on Text Torrent for Compliance Review

Any review, approval, suggestion, template, rewrite, warning, flag, restriction, recommendation, or communication provided by Text Torrent in connection with your account, campaigns, messages, calls, recordings, routing, or use of the Services is provided solely for operational convenience and does not constitute legal advice, regulatory approval, or a certification of compliance. Text Torrent is not your attorney, compliance officer, telemarketing advisor, or regulatory consultant. You remain solely responsible for ensuring that your use of the Services complies with all applicable laws, regulations, carrier rules, consent requirements, telemarketing restrictions, caller ID requirements, and recording laws.

7. Reporting Violations

If you believe that any person or account is violating this Policy, please contact us immediately at info@texttorrent.com and provide any information reasonably available to you, including message samples, call samples, screenshots, phone numbers, caller IDs, campaign details, call recordings, timestamps, logs, or other supporting documentation that may assist us in investigating the matter.

We may, but are not obligated to, investigate reports of suspected misconduct, abuse, unlawful messaging, unlawful calling, spoofing, fraud, phishing, harassment, recording violations, or any other conduct that may violate this Policy, our Terms of Service, carrier rules, or applicable law.

8. Updates to This Policy

We may revise this Acceptable Use Policy from time to time to reflect changes in our Services, platform features, legal requirements, carrier rules, provider requirements, or risk standards. Any changes will be posted on our website with a revised "Last Updated" date, and such changes will become effective upon posting unless otherwise stated.

Your continued use of the Services after an updated version of this Policy is posted constitutes your acceptance of the revised Policy. If you do not agree to the revised Policy, you must stop using the Services.
